RE: Call a Hearing on the Bankruptcy of MF Global

Dear Senator Roberts:

I applaud your leadership in calling for urgent action to address a hearing to be focused “solely” on the MF Global, Inc. bankruptcy. This is, indeed, a severely urgent matter facing thousands of individuals and many sectors of our economy, including the future integrity of US markets. The handing of the bankrutpcy is the burning fire to be addressed at this very moment.

The Congressional mandate of the CFTC to protect commodity customers in the event of the bankruptcy of an FCM under federal regulation (17 CRF 190.08) appears to have been completely subordinated by the SIPC and thus delegated to bankruptcy to a court appointed bankruptcy Trustee.

A liquidating Trustee is under no requirement to act in the interest of damaged individuals, the agricultural sector and related industries. The purpose of a bankruptcy court is to, use “whatever legal means are available” to maximize the assets of the estate, as his spokesman (Mr. Kent Jarrel of APOC World Wide) said yesterday. .

Now that all authority has been delegated to a federal bankruptcy court, I respectfully ask how may the Court award third party interests be awarded superior treatment over customer segregated deposits?

The system of regulation in the commodities industry and protection of all participants is based on a bedrock principle: That customer segregated funds are protected from the assets of third parties, even in the event of bankruptcy of an FCM. Without this principal going back over 150 years in the United States, an entire industry and thousands of individuals will fail. The ongoing bankruptcy proceedings are rapidly undermining this foundation and contributing to assured destruction of innocent parties. As you are aware, confidence in not just the commodities markets has been gravely effected, but rather in the regulators and Even the Integrity of the US Financial System.

Again, I applaud and thank you. I support you for your display of leadership and call for an urgent hearing on the handing of the MF Global, Inc. bankruptcy.
