Letter to Send to Politician or Media regarding MF Global

Re: Investors have no chance

Dear (Editor, Senator, Congressman, Candidate, etc:

MF Global’s bankruptcy has shattered market confidence. Virtually everyone involved in this fiasco has put self-interest ahead of the well-being of investors and the economy.

A recent court order provides some distributions to customers meeting certain criteria; however, this order only applies to a minority of customers. As each day passes, farmers and businesses face financial collapse, retirees struggle to keep homes, and jobs will be lost. In an under-handed legal move, JP Morgan Chase filed a questionable motion to be paid before return of customer property.

The Commodity Futures Trading Commission (CFTC) improperly ceded jurisdiction over 150,000 commodity accounts to the Securities Investor Protection Corporation which has jurisdiction over less than 500 securities accounts. CFTC’s impotence demonstrates that the federal government will not protect customers. If the CFTC had tightened permissible investments under Regulation 1.25 as it proposed in 2010, and not succumbed to industry pressure, this bankruptcy might have been averted.

The CME Group watches as the commodities and futures industry crumbles from the mismanagement of customer funds by MF Global’s executives and given this incompetence, self-interest and indifference, there is no safe place to invest and there is now no trust in the U.S. Financial system.

Court filings reveal $41 billion in assets in the estate from which customers can and should be made whole, on a priority basis above all creditors. The customer segregated funds short-fall is $600 million; and at a minimum, $1.2 billion represents debt-free net assets from which customers can and should be made whole. A plan by the Commodities Customer Coalition (7,000 affected customers) proposes efficient electronic communications and would distribute customer funds in weeks. We strongly urge support of this proposal.
